2. To whom these Terms are applicable
These Terms apply to all Visitors, Users, Schools, Persons who access or use this website.
2.1 Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using this website.
2.2 Your use of this website is conditional upon Your acceptance of and compliance with these Terms which You agree to be bound by.
2.3 If You do not agree to these Terms and Conditions, then You must not, and agree not to access this website.
2.4 You are also expected to check these Terms from time to time to ensure You have taken notice of any changes that may have been made as they are binding on You.
3. Revisions/Changes to Terms
We reserve the right to modify, add or replace Our Terms at any time, based on Our own assessment criteria and at Our sole discretion, and as such, the modified Terms shall be effective immediately upon being posted on this website. Accordingly, Your continued access or use of this Website is deemed to be Your acceptance of the modified Terms and Conditions.

5.3 You should not publish, distribute, infringe, duplicate, reproduce any of the free, purchased or Subscription Resources Materials and/or Documents made available on this website.
5.4 You may download and/or print any of the Free Resources which are available on this Website.
5.5 You may download the Resources which are made available through a purchased Subscription on this website provided that their use is solely for educational purposes in the GES Simply Letters and Sounds Programme. There is a download limit against such Resources.
5.6 You must not use any of the Resources materials (in part or entirety) on this website for commercial purposes.
5.7 You should not share, distribute, copy, reproduce any of downloaded or purchased Resources Materials and Documents which are made available in Your purchased Subscription with other any schools. They are intended solely for use by the purchasing School only.
5.8 A separate Subscription purchase is required for each School within a Trust that wishes to use the GES Subscription feature.
6. Appropriate Use
You agree that You must not knowingly or otherwise, use any form of engineered software code/routines/algorithms, or any forms of hardware devices to deliberately interfere manually or electronically with the operation of this Website. This includes attempts to upload of code containing viruses via whatever means. Such attempt(s) will constitute to be a criminal offence which GES will take appropriate action and will also permanently block/cease Your right to access and use this website.
7. Changes to this website
We reserve the right to make improvements or changes to the website (e.g. information, services, Resource materials) or terminate this website, at any time without notice.
8. Access to the Website
8.1 Access to this website is conditional on You using appropriate computer hardware equipment with licensed software and internet access services.
8.2 We reserve the right to determine the accessibility criteria to the Free Resources material made available on this website. We also reserve the right to suspend or remove this access from the website.
8.3 We reserve the right to amend, add, remove any of the Free Resources material from this website without giving prior notice.
8.4 We will not be held liable if this website is unavailable due to technical faults at any time or for any period due to circumstances beyond our control. We will, however, at our discretion, aim to give advance notification of any temporary outages of the website to enable Us to enhance/improve the website service and/or features.
9. Security of School Account
9.1 When You request a School Account, We will process Your request and at Our discretion, issue You with a School Account Login Id and a link to reset the password. You are then responsible for always maintaining the confidentiality of Your School Account Login Id and password. This means You must ensure that it is secure, confidential, only to be used by an authorised person, and not to be disclosed to any unauthorised person(s).
9.2 If You have reasons to believe or suspect that access to Your Account is no longer secure and has become known to unauthorised person(s) (e.g. by loss, theft or unauthorised disclosure), You must promptly change the affected access information (e.g. the password).
9.3 You must inform Us immediately if You suspect that Your School Account Login Id or password is being used by an unauthorised person/user.
9.4 You are encouraged to routinely change Your School Account password to be compliant with standard information security protocols.
9.5 We reserve the right to disable a school account at any time, if, in Our opinion, You have failed to comply with these Security Terms.
10. Information About You
Any information that is collected about You will be processed in accordance with the Privacy Policy of Global Education Services Ltd which can be viewed on this website. When using this website, You are giving Your consent to the processing of the information You provide/have provided and You agree that this information is correct and accurate.
11. Our Liability
11.1 Our aim is to provide “Free Resources” and “Resources to Purchase” materials on this Website which are as accurate as possible. The materials examples shown on this Website are provided without any guarantees, conditions, or warranties.
11.2 By using this Website, You accept that You are doing so at Your own risk and that We may not be held responsible for any direct or consequential losses.
12. Training – Terms
12.1 We reserve the right to set and periodically review the cost of the Training Courses We offer. The current cost of each Training Course is shown on the website.
12.2 You can book Training Courses offered on this website by submitting an online Course Booking Form for each course.
12.3 You must provide all the mandatory details on the Course Booking Form when booking a Training Course. Incomplete booking forms will not be accepted by the Website.
12.4 You will be invoiced for the Training Course(s) You have requested. The Invoice will be emailed to the Email Id You provide Us on the Course Booking Form.
12.5 We cannot guarantee that Your requested Training dates will be met. If We cannot meet Your requested date, We will offer You an alternative date.
12.6 You must settle the Invoice payment by BACS within 10 days on completion of the Training. We will contact You if We do not receive Your payment within this timeframe. We reserve the right to charge interest on the overdue Invoice amount.
12.7 You can cancel a booked Training Course by giving us prior notification of five working days before the booking date. We reserve the right to Invoice You for the full amount and expect the Invoice be paid if We do not receive Your cancellation notification within this timescale.
12.8 If You want to reschedule a booked Training course, please contact Us by giving prior notification of five working days before the original scheduled booking date.
13. Free Resources – Terms
You may download and/or print any of the Free Resources which are available on this Website provided that their use is intended solely for educational and school classroom purposes.
14. Resources to Purchase – Terms
14.1 We reserve the right to set and periodically review the cost of each resource in our Resources to Purchase Catalogue. The current cost of each Resource will be shown on the website.
14.2 You may purchase any Resources from the Resources to Purchase Catalogue on this website. These Resources are printed resources only.
14.3 You must provide Your contact details and delivery address together with a Purchase Order Number when placing an order. We will not be held accountable for any delay to Your order if the information You provide Us is incorrect.
14.4 We will invoice You for the Purchase Order placed, the packaging cost and delivery/shipping cost. The Invoice will be emailed to the Email Id You provide us on Your order.
14.5 You must settle the Invoice payment by BACS within 10 days of the Invoice date. We will contact You if your payment has not been received within this timeframe.
14.6 Your order will be fulfilled and delivered to the shipping address You have provided Us on Your Purchase Order after We have received the full payment. You will then own the Resources and be responsible for them.
14.7 You are responsible for Resources from the time they have been delivered to Your address that You have provided.
14.8 You must notify us immediately if there are any discrepancies between your order and the delivered items. We will aim to rectify any discrepancies notified to us, once our investigations have been completed and We have agreed a resolution with You.
15. Subscription – Terms
15.1 We reserve the right to modify/terminate Our Subscriptions model at any time.
15.2 A Subscription can only be purchased online at the time you request a School Account. After a Subscription has been purchased, it will be activated and you will be given access to download the Resources provided under Our Subscription model. A download limit will be set against each downloadable resource. Once the download limit for a resource has been reached, it cannot be extended.
15.3 A paid for Subscription is non-transferable.
15.4 Resources from the Resource Catalogue must be purchased separately and are not included in the Subscription.
15.5 We reserve the right to determine and/or change the Subscription fees on an annual basis. Any changes to the subscription fee and effective date will be published on this website.
15.6 All Subscriptions (new or renewals) are required to be paid for in advance.
15.7 Subscriptions are non-refundable. A refund request will be assessed as per Our Subscription Terms 15.11 and 15.12.
15.8 We will invoice You for Your Subscription purchase order.
15.9 You must settle the Invoice payment by BACS within 10 days of the Invoice date. We will contact you if we have not received your payment within this timeframe. If payment is not received within 10 days, We reserve the right not to activate your Subscription until payment is received. The Invoice will be emailed to the Email Id provided in Your School Account.
15.10 If you have an activated Subscription, We will maintain counts of number of downloads made of Subscription Resources and Documents. We will use this information to manage your Subscription.
15.11 Once You have purchased a Subscription and We have activated it after receiving the full payment, We will give you five working days from date of activation during which You may request a cancellation of your Subscription subject to Subscription Term 15.12.
15.12 To cancel a Subscription, please contact Us by e-mail at [email protected]
15.13 A Subscription cannot be cancelled after activation if there has been a download activity of any resources material.
16. Links from this Site
This website includes links to publishing companies with whom We have partnered so that you are able to choose and purchase books which complement the GES Simply Letters and Sounds programme. Your access to the website of these companies for their products and services is at Your own discretion.
17. Linking To This Site
You may link to any free page on this site, provided You do so in a way that is fair and legal and does not damage Our reputation or take advantage of it, but You must not establish a link in such a way as to suggest any form of association, approval, or endorsement on Our part where none exists.
